Terms of Service

These Terms of Service (“Terms”) govern your use of the Arkhipelag website (travel.arkhipelag.com) and any booking made through our platform. By using the website, submitting a booking request, completing identity verification, or completing a payment, you agree to these Terms.

If you do not agree to these Terms, you must not use the website or make a booking through it.

1. About Arkhipelag

1.1 The Arkhipelag platform is operated by ARKHIPELAG Co., Ltd., registration number 0835566018842, registered address 63/202 Moo 2, Ko Kaeo Subdistrict, Mueang Phuket District, Phuket Province, 83000, Thailand (“Arkhipelag”, “we”, “us”, “our”).

1.2 Arkhipelag is an online booking platform that connects customers with independent local providers in Thailand.

1.3 Arkhipelag is not a tour operator, travel agency, guide service, transport provider, vehicle rental company, event organizer, ticket issuer, caterer, food business operator or accommodation provider, and does not organize or perform any of the services listed on the platform.

1.4 Our role is limited to providing a booking platform, facilitating communication where necessary, processing booking payments, transmitting booking information to providers, and providing customer support in relation to bookings made through the platform.

1.5 All services listed on Arkhipelag are provided and performed by independent local businesses (“Providers”). Depending on the category, a Provider may be a tour operator, an activity operator, a transport or vehicle rental company, an event organizer or ticket issuer, a catering company, or another supplier of travel-related services.

2. What You Can Book

2.1 The Arkhipelag catalogue includes, and may from time to time include, the following categories of services (together, the “Services”):

  • Tours and activities, including guided tours, island and marine trips, excursions, sightseeing, diving, snorkelling and similar experiences;
  • Transport and vehicle rental, including car, motorcycle, scooter, bicycle, boat and yacht rental, private transfers, drivers and other transport arrangements;
  • Tickets for events, shows, performances, attractions, parks and other venues;
  • Bespoke event catering, including catering ordered to specification for private and corporate events;
  • Other travel-related services that we may add to the catalogue from time to time, such as equipment hire, photography, wellness and spa services, and similar offerings.

2.2 Not every category is available in every location or at all times. We may add, change or withdraw categories, listings and Providers at any time.

2.3 These Terms apply to all Services booked through the platform. Section 13 sets out additional conditions that apply to particular categories, and the listing page for each Service may set out further conditions specific to it. Where a category-specific or listing-specific condition conflicts with a general provision of these Terms, the more specific condition prevails for that booking.

3. Who These Terms Apply To

3.1 “You”, “your” and “customer” mean: (a) any person who accesses or uses the Arkhipelag website; (b) any person who submits a booking request or completes a payment through the platform; and (c) any person on whose behalf a booking is made, including a participant in a tour or activity, a driver or hirer of a rented vehicle, a ticket holder, or the recipient of a catering order.

3.2 If you make a booking or a payment on behalf of another person, you confirm that you are authorised to act on their behalf and that you have made them aware of these Terms, the Refund Policy and the Privacy Policy. You are responsible for the accuracy of the information you provide about them.

3.3 You must be at least 18 years old to make a booking. Bookings that include minors must be made by an adult who accepts responsibility for them, and minors may participate or attend only under the conditions stated on the relevant listing page or set by the Provider.

3.4 In addition to these Terms, specific Services may be subject to further conditions shown on the listing page, for example minimum age, licence requirements, health or fitness requirements, participant limits, security deposits, or a stricter cancellation policy. Those conditions form part of these Terms.

4. Changes to These Terms

4.1 Arkhipelag may update these Terms from time to time. The latest version will be published on the website with the updated effective date.

4.2 Continued use of the website after publication constitutes acceptance of the updated Terms. The version of the Terms in force at the time your booking is confirmed applies to that booking.

5. Access to and Use of the Platform

5.1 Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable right to access and use the platform for your own personal, non-commercial purposes in connection with booking Services. Bookings of catering or other Services for a business or corporate event are permitted, but the platform may not be used to resell Services or to operate a competing booking service.

5.2 We do not guarantee that the website will always be available, uninterrupted or error-free. We may change, suspend, withdraw or discontinue all or any part of the website or its content at any time, without notice and without liability.

5.3 You are responsible for arranging your own internet access and for ensuring that anyone who uses the website through your connection or on your behalf is aware of and complies with these Terms.

5.4 We may restrict, suspend or terminate your access to the platform where we reasonably believe these Terms have been breached, where fraud or misuse is suspected, or where required by law.

6. Accounts and Booking Records

6.1 Certain functions may require you to create an account or to access a booking using the reference and contact details provided at the time of booking.

6.2 You must provide accurate and complete information and keep your access credentials confidential. You are responsible for all activity carried out under your account or booking reference.

6.3 You must not use another person’s identity or create an account on another person’s behalf without their consent.

6.4 We may refuse, suspend or close an account at our discretion, in particular where inaccurate information has been provided or where fraud is suspected.

7. Booking Relationship

7.1 When a booking is made through Arkhipelag, the contractual relationship regarding the performance of the Service is formed between the customer and the selected Provider.

7.2 Arkhipelag acts solely as the platform through which the booking and payment are processed and booking information is transmitted to the Provider.

7.3 The Provider is solely responsible for organizing, supplying and performing the booked Service, including the condition and roadworthiness of any rented vehicle, the staging of any event, the validity and admission rights attached to any ticket, and the preparation, safety and delivery of any catering.

8. Booking and Payment

8.1 To make a booking, you must provide accurate and complete booking information, including the name of the person who will receive the Service and the required contact details, together with any further information the listing requires, such as licence details for a vehicle rental, or the menu, headcount, venue and timing for a catering order.

8.2 Every booking requires identity verification before payment is accepted, as described in section 9.

8.3 Some bookings are confirmed instantly; others require confirmation from the Provider and may take time. Bespoke Services, including catering, are confirmed only once the specification and the price have been agreed in writing. A booking is binding only once we have issued a booking confirmation.

8.4 The booking confirmation identifying the customer constitutes the primary record of the person entitled to receive the booked Service.

8.5 You may receive a booking confirmation, digital voucher, ticket or booking reference. You must be able to present it, together with identification where requested, at the pickup point, meeting point, rental desk or venue.

8.6 Payment confirms acceptance of these Terms and the Refund Policy and forms part of the booking record.

8.7 Arkhipelag may refuse or cancel a booking if payment is not received, if identity verification is not completed, if fraudulent activity is reasonably suspected, or if required booking information is incomplete or inaccurate.

9. Identity Verification

9.1 Verification is required for every purchase. Before a booking can be completed and a payment accepted, the person making the booking must complete an identity verification check. It is not possible to complete a purchase on the platform without passing this check.

9.2 Why we verify. We verify identity in order to secure payments, to protect customers and Providers against fraud and unauthorised use of payment instruments, and to meet the identity verification and “know your customer” (KYC) requirements applicable to us and to our payment service providers.

9.3 Who carries out the check. Verification is performed through Didit, an independent identity verification provider established in Spain, acting as our service provider. You will be directed to Didit’s verification flow, and Didit processes the information you submit on our behalf, on our instructions and under a data processing agreement.

9.4 What the check involves. The verification check consists of:

  • submitting a photograph or scan of a valid identity document, such as a passport, national identity card or driving licence;
  • verification of your email address, by confirming a code sent to it; and
  • verification of your telephone number, by confirming a code sent by SMS.

9.5 What the check does not involve. The verification check does not include facial recognition, biometric comparison of your face against your document, liveness detection, or the capture of a selfie or video for those purposes. We do not create, collect or store biometric identifiers or biometric templates, and we do not use your data for biometric identification.

9.6 Verification is separate from any Provider requirement. Passing our verification does not replace any document a Provider requires in order to supply the Service, such as a driving licence at a rental desk or proof of age at a venue.

9.7 Your obligations. You must provide accurate and genuine information and documents. Submitting a document belonging to another person, or an altered, forged or otherwise misleading document, is a serious breach of these Terms and may be reported to the competent authorities.

9.8 If verification is not completed or is unsuccessful. Where verification is not completed, or where its result is unsuccessful or inconclusive, the booking cannot be completed and no payment will be taken. Where an amount has nevertheless been taken, it will be returned in full to the original payment method in accordance with the Refund Policy, and no cancellation charge will apply.

9.9 Repeat verification. We may require verification to be repeated, including where you make a further booking after a significant period, where the details you provide change, where a refund is requested, where a payment is disputed, or where fraud is reasonably suspected.

9.10 Review of an automated decision. Verification decisions may be reached wholly or partly by automated means. If a check fails and you believe the outcome is incorrect, you may contact us at support@arkhipelag.shop and ask for the matter to be reviewed with human involvement, to express your point of view, and to submit further information.

9.11 Data protection. Information submitted for verification is processed as described in the Privacy Policy, which sets out what is collected, who has access to it, and how long it is kept.

10. Payment by a Third Party, Security Screening and Fraud Prevention

10.1 Third-party payments are permitted in principle. A booking may be paid for by the customer personally or by another person acting on the customer’s behalf, including a family member, friend, employer, company or other third party. Corporate payment for event catering and group bookings is expressly contemplated.

10.2 Payer confirmations. By completing a payment, the payer confirms that:

  • the payment is made for the booking identified in the booking confirmation;
  • the payer is the authorised holder of, or is authorised to use, the payment method used;
  • the person named in that booking is authorised to receive the Service; and
  • the payer accepts these Terms and the Refund Policy.

10.3 Payments may be declined for security reasons. Payments made by a person other than the named customer carry an increased risk of unauthorised use of payment instruments and of payment fraud. For security reasons, and in order to prevent fraud, Arkhipelag, its payment service providers and the issuing bank may, at their own discretion and without any obligation to give reasons:

  • decline, reject or refuse to process a payment, including a payment made by a third party;
  • place a payment or a booking on hold pending verification;
  • request additional verification before confirming the booking, including verification of the payer’s identity, confirmation that the payer authorised the payment, or information about the relationship between the payer and the customer;
  • cancel a booking where the requested verification is not provided within a reasonable period, or where the outcome of the verification is unsatisfactory; and
  • refuse to accept further payments from the same payment method, payer, account, device or IP address.

10.4 Automated screening. Payments are processed by third-party payment providers whose automated fraud-prevention systems may decline a transaction independently of Arkhipelag. We do not control those systems and are not able to override their decisions.

10.5 Effect of a declined payment. Where a payment is declined, held or cancelled under this section, the booking is not confirmed, or, if already confirmed, may be cancelled. Where funds have already been taken, they will be returned to the original payment method. We are not liable for any loss arising from a payment being declined, held or cancelled under this section, including where the Service subsequently becomes unavailable, sells out, or is offered at a different price.

10.6 Reported unauthorised payments. If a payment is reported as unauthorised, or a chargeback or payment dispute is initiated, we may suspend or cancel the affected booking, notify the Provider, and require payment by a verified method before the Service is performed.

10.7 No discrimination against legitimate payers. Nothing in this section is intended to prevent legitimate payments on behalf of a customer. Where the checks described in sections 9 and 10 are completed satisfactorily, the identity of the person who made the payment does not affect the validity of the booking or the performance of the Service.

11. Prices, Fees and Currency

11.1 Prices are displayed on the relevant listing page and include the items expressly listed as included. Items listed as not included are payable separately.

11.2 Certain charges may be payable directly at the venue or to the Provider, where this is stated on the listing page. These may include national park fees, pier fees, entrance fees, equipment hire, environmental levies, fuel, tolls, parking, security deposits for rented vehicles, corkage or venue charges for catering, and similar amounts.

11.3 Prices for bespoke Services, including catering, are quoted individually on the basis of the specification you provide. A quotation is valid for the period stated in it and may be revised if the specification, headcount, venue or date changes.

11.4 Prices, available payment methods and promotions may change at any time. Changes do not affect bookings already confirmed.

11.5 Where a payment is made in a currency other than the currency of your payment method, your bank or payment provider may apply conversion rates and additional fees. Those charges are set by your provider, are not received or controlled by Arkhipelag, and are not refundable by us.

12. Performance of the Booked Service

12.1 The booked Service is performed or supplied by the selected Provider.

12.2 Arkhipelag’s obligations are fulfilled when the booking has been properly processed and transmitted to the Provider, and the Provider has performed or materially performed the booked Service for the customer identified in the booking confirmation. For tickets, our obligations are fulfilled when a valid ticket or admission entitlement has been delivered to you.

12.3 Subject to sections 9 and 10, the identity of the person who made the payment does not affect the validity of the booking or the performance of the Service.

13. Additional Conditions by Category

13.1 Tours and activities

13.1.1 You must arrive at the designated pickup or meeting point at the stated time and comply with safety instructions and reasonable directions given by the Provider.

13.1.2 Where a tour states health, fitness, age, weight or swimming requirements, you must meet them and must disclose any relevant medical condition, pregnancy, allergy or mobility limitation where the listing requires it.

13.1.3 The Provider may refuse participation, without refund, where these requirements are not met.

13.2 Transport and vehicle rental

13.2.1 Licences. You must hold a valid driving licence for the class of vehicle rented and, where required by Thai law, an International Driving Permit or a Thai licence. Driving without the correct licence is unlawful, will usually invalidate insurance, and may result in the rental being refused without refund.

13.2.2 Legal requirements. You must comply with Thai road traffic law at all times, including helmet requirements for motorcycles and scooters, and must not drive under the influence of alcohol or drugs.

13.2.3 Rental agreement. Vehicle rental is subject to a separate rental agreement between you and the Provider, which governs insurance, excess, permitted use, geographical limits, fuel policy, mileage, additional drivers and return conditions. Read it before signing.

13.2.4 Security deposits. The Provider may require a security deposit or a card pre-authorisation at the rental desk. Deposits are collected, held and returned by the Provider, not by Arkhipelag, and are outside the scope of the amount you pay through the platform.

13.2.5 Passports as security. You are not required to surrender your passport as security for a rental booked through Arkhipelag. If a Provider asks you to leave your passport, you may decline and should contact us.

13.2.6 Condition of the vehicle. Inspect the vehicle before taking it and record any existing damage with the Provider, ideally with dated photographs. Damage, loss, theft, fuel shortfalls, traffic fines, tolls, impound charges and insurance excess are matters between you and the Provider, and Arkhipelag is not a party to them.

13.2.7 Return. Late return may incur additional charges set by the Provider. Early return does not entitle you to a refund of unused rental time unless the Provider agrees.

13.3 Tickets for events and attractions

13.3.1 Tickets are issued by, and admission is granted by, the event organizer or venue. Admission is subject to their terms, house rules, security checks, dress codes and age restrictions.

13.3.2 Tickets are frequently non-refundable and may be non-transferable or personalised. The conditions applicable to a ticket are shown on the listing page before you book, and they prevail over the standard cancellation terms.

13.3.3 Where an event is cancelled, postponed, rescheduled, relocated or materially changed by the organizer, the outcome, including whether a refund or an alternative date is offered, is determined by the organizer. We will pass on what the organizer offers and will assist you in obtaining it.

13.3.4 You must not resell a ticket booked through the platform above face value or in breach of the organizer’s terms.

13.3.5 Line-ups, timings, performers, seating and programme content are set by the organizer and may change. Such changes do not, in themselves, give rise to a refund from us.

13.4 Bespoke event catering

13.4.1 Specification. Catering is supplied to order. A booking is confirmed only once the menu, headcount, date, time, venue, delivery or service arrangements and price have been agreed in writing.

13.4.2 Deposits. A deposit may be required to confirm the order. Where stated at the time of booking, a deposit may be non-refundable once the Provider has begun procurement or preparation.

13.4.3 Final headcount. You must confirm the final headcount by the deadline stated in the booking confirmation. After that deadline, reductions are charged in full, and increases are subject to the Provider’s capacity and may be priced separately.

13.4.4 Allergens and dietary requirements. You must notify all allergies, intolerances and dietary or religious requirements in writing before the deadline stated in the booking confirmation, and you are responsible for the accuracy and completeness of that information. Kitchens handle multiple ingredients, and Providers cannot guarantee the absence of cross-contamination. Where an allergy is severe, discuss it with the Provider directly before confirming the order.

13.4.5 Venue and access. You are responsible for ensuring the Provider has timely access to the venue, together with any power, water, space, permissions and licences the venue requires, unless expressly agreed otherwise. Delays or additional costs caused by lack of access or missing permissions are your responsibility.

13.4.6 Alcohol and permits. Where an event involves the supply of alcohol or requires a public event, noise, beach or municipal permit, obtaining and holding the required permission is your responsibility unless the booking confirmation expressly states that the Provider will obtain it.

13.4.7 Food safety after handover. Once food has been delivered or served, its storage, holding temperature and consumption are your responsibility. Follow the Provider’s instructions on serving and holding times.

13.4.8 Equipment. Serving equipment, linen and similar items supplied by the Provider remain the Provider’s property, and you are responsible for loss or damage while they are at the venue.

13.5 Other Services

13.5.1 Where a Service does not fall within the categories above, the conditions shown on its listing page apply in addition to these Terms, together with any conditions of the Provider notified to you before booking.

14. Changes and Cancellations

14.1 Cancellations, booking changes and refunds are governed by the Arkhipelag Refund Policy and, where applicable, by the cancellation conditions of the selected Provider or event organizer.

14.2 Cancellation conditions differ between categories. Tickets and bespoke catering commonly carry stricter terms than tours and activities. Please review the applicable cancellation terms before completing your booking.

15. Provider Responsibility

The Provider is solely responsible for:

  • supplying the Service as described;
  • organizing transportation, guides, boats, vehicles, equipment, staff, food and meals where applicable;
  • the roadworthiness, maintenance, insurance and legal compliance of any vehicle supplied for rental;
  • the staging, safety and conduct of any event, and the validity of any ticket and the admission rights attached to it;
  • the preparation, hygiene, labelling, handling and delivery of any food and beverages, and compliance with food safety law;
  • ensuring safety during the performance of the Service;
  • holding the licences, permits and insurance required for its activity, and complying with applicable laws and regulations;
  • communicating operational information such as pickup times, schedule changes, weather conditions, delivery windows and other matters relating to the Service.

Arkhipelag is not responsible for the actual performance of the Service or for the acts or omissions of the Provider.

16. Customer Responsibilities

16.1 By making a booking, you confirm that:

  • the information provided is accurate and complete;
  • you and any other participant are able to take part in the booked Service, and any relevant medical condition, pregnancy, allergy, dietary requirement or mobility limitation has been disclosed where the listing requires it;
  • you hold any licence, permit or document required for the Service, including a valid driving licence for a vehicle rental;
  • you will arrive at the designated pickup point, meeting point, rental desk or venue on time;
  • you will comply with safety instructions, venue rules and reasonable directions provided by the Provider.

16.2 The Provider may refuse to supply the Service, without refund, where you are under the influence of alcohol or drugs, behave in a manner that endangers others or damages property, or do not meet the stated requirements for the Service.

16.3 Failure to comply with these obligations may result in denial of the Service without refund.

17. Travel Documents, Health and Insurance

17.1 You are solely responsible for holding valid travel documents and for meeting any visa, immigration, health or vaccination requirements applicable to your travel.

17.2 Providers may require identification or other documents in order to supply the Service, including for national park entry, vehicle rental, age-restricted events or insurance purposes. Failure to present them may result in refusal of the Service without refund.

17.3 Arkhipelag strongly recommends that customers hold travel and medical insurance appropriate to the Services booked, including cover for water-based and adventure activities, and for the operation of motorcycles and scooters where relevant. Many travel insurance policies exclude motorcycle use without the correct licence. Prices do not include personal travel insurance unless expressly stated.

18. Weather and Operational Conditions

18.1 Many Services in Thailand and other regions depend on weather and marine conditions, in particular tours, marine activities, boat rentals and outdoor events and catering.

18.2 If the Provider cancels the Service due to unsafe weather or official restrictions, you will be offered a refund or an alternative date where available.

18.3 If the Service is supplied as scheduled, no refund is available solely because weather conditions were less favourable than expected.

18.4 Providers may adjust routes, stops, timings, menus or the order of activities for reasons of safety, weather, tides, traffic, ingredient availability or regulatory restriction. Such adjustments do not, in themselves, give rise to a refund where the Service is materially performed.

19. Payments and Refunds

19.1 Payments made through Arkhipelag are processed as part of the booking process for the selected Provider.

19.2 Once the booked Service has been supplied or materially performed for the customer identified in the booking confirmation, the booking is considered completed and the corresponding payment obligation is considered fulfilled.

19.3 Refunds are available only in the circumstances described in the Refund Policy.

20. Promotions, Discounts and Referrals

20.1 We may offer discount codes, coupons, credits or referral benefits from time to time (“Promotional Benefits”).

20.2 Promotional Benefits have no cash value, may be limited in time, quantity or category, cannot be sold, transferred or combined unless expressly stated, and are subject to any additional conditions published with them.

20.3 We may withdraw, suspend or cancel Promotional Benefits, and may cancel affected bookings or suspend accounts, where a benefit is obtained or used fraudulently, through multiple or automated accounts, or otherwise in breach of its conditions.

21. Reviews, Ratings and User Submissions

21.1 After a Service, we may invite you to leave a review. You may also submit photographs, comments or other materials (“User Submissions”).

21.2 You must ensure that your User Submissions are truthful, lawful, and do not infringe the rights of any third party, and that you hold all rights necessary to submit them.

21.3 By submitting a User Submission, you grant Arkhipelag a worldwide, royalty-free, transferable, sub-licensable and perpetual licence to use, reproduce, adapt, translate, publish, display and distribute it in connection with operating and promoting the platform and the Services listed on it, including on social media and in marketing materials.

21.4 We may edit, translate, decline to publish or remove any User Submission at our discretion, in particular where it is unlawful, abusive, misleading, or unrelated to the booked Service.

21.5 Where a User Submission contains images of other identifiable people, including guests at an event, you confirm that you have obtained their consent.

22. Intellectual Property

22.1 All content on the Arkhipelag website, including text, images, graphics, logos, software and other materials, is owned by Arkhipelag or its licensors and is protected by applicable intellectual property laws.

22.2 You may view content and download or print a reasonable amount of it for your own personal, non-commercial use, provided all proprietary notices are retained.

22.3 You may not reproduce, distribute, modify, create derivative works from, publish, license, sell or otherwise use any content from the website without prior written permission.

23. Prohibited Conduct

You agree not to:

  • use the platform for unlawful purposes;
  • provide false or misleading booking information;
  • submit fraudulent payment information, or use a payment instrument you are not authorised to use;
  • submit an identity document belonging to another person, or an altered, forged or otherwise misleading document, or attempt to circumvent identity verification;
  • resell tickets or other Services booked through the platform in breach of these Terms or the Provider’s conditions;
  • interfere with the operation of the website, or introduce malicious code;
  • attempt to gain unauthorised access to the website, its systems or other users’ data;
  • scrape, crawl, index, mine or otherwise extract data from the platform by automated means, or reverse engineer any part of it;
  • harass or abuse Arkhipelag staff, Providers or other users; or
  • copy or redistribute platform content without permission.

24. Third-Party Links and Services

24.1 The website may contain links to third-party websites, applications or services. These are provided for convenience only and do not imply endorsement.

24.2 We do not control and are not responsible for the content, products, services or privacy practices of third parties. Any dealings between you and a third party are solely between you and that third party.

25. Indemnity

You agree to indemnify and hold harmless Arkhipelag, its officers, employees and agents against any claims, liabilities, damages, losses and reasonable costs arising out of your use of the platform, your breach of these Terms, your use or operation of a rented vehicle, your conduct at a venue or event, your violation of applicable law, or your infringement of the rights of any third party.

26. Disclaimers

26.1 The website and the platform are provided on an “as is” and “as available” basis, without warranties of any kind to the fullest extent permitted by law.

26.2 We do not warrant that descriptions, photographs, prices, availability, schedules, menus, line-ups or other information supplied by Providers are complete, accurate or up to date, although we take reasonable steps to keep listings accurate.

26.3 We do not warrant that the website will be secure, uninterrupted or free of errors or viruses.

27. Limitation of Liability

To the maximum extent permitted by law:

  • Arkhipelag’s liability arising from any booking is limited to the amount paid through the platform for that booking; and
  • Arkhipelag is not liable for indirect, incidental, consequential or special damages, including lost vacation time, missed flights, accommodation costs, event disruption, traffic fines, vehicle damage or excess, or other travel-related losses.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence and liability for fraud.

28. Suspension and Termination

28.1 We may suspend or terminate your access to the platform at any time, with or without notice, where we reasonably consider it necessary, including in cases of suspected fraud, breach of these Terms or risk to other users or Providers.

28.2 Provisions which by their nature are intended to survive termination — including sections 22, 23, 25, 26, 27, 29 and 30 — will continue to apply.

29. Governing Law and Jurisdiction

29.1 These Terms are governed by the laws of Thailand.

29.2 Any dispute arising from or relating to these Terms, a booking made through Arkhipelag, or the use of the platform shall be subject to the exclusive jurisdiction of the competent courts of Phuket, Thailand.

29.3 Nothing in this section deprives a consumer of the protection of any mandatory provisions of the law of their country of residence where such protection cannot be excluded by agreement.

30. Miscellaneous

30.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force.

30.2 Our failure to enforce any provision does not constitute a waiver of it.

30.3 You may not transfer your rights or obligations under these Terms without our consent. We may transfer ours, including in connection with a reorganisation or sale of the business.

30.4 These Terms, together with the Refund Policy, the Privacy Policy and any listing-specific conditions, constitute the entire agreement between you and us regarding the platform.

30.5 These Terms are published in English. Where a translation is provided, the English version prevails in the event of any inconsistency.
